1) About Us & Acceptance of Terms

These Terms & Conditions (the "Terms") govern your access to and use of services provided by The Tox Dallas University Park, LLC ("The Tox Dallas," "we," "our," or "us"), including our website pages we control on thetoxtechnique.com, our booking and communication platforms (Mindbody, HighLevel, RingCentral, Twilio), and services at 4348 Lovers Ln, Dallas, TX 75225.

By visiting our website, booking an appointment, receiving messages from us, or using our services, you agree to these Terms. If you do not agree, do not use our services.

Franchise Disclosure. We are an independently owned and operated franchise location of The Tox. These Terms govern our local studio only.

2) Changes to Terms

We may update these Terms at any time. Changes are effective upon posting with a revised "Effective Date." Your continued use after updates constitutes acceptance.

3) Eligibility & Client Responsibilities

  • Age. Services are intended for individuals 18+. Minors must have a parent/guardian present and consenting where permitted.

  • Accuracy. You agree to provide accurate, current information in bookings, forms, and communications.

  • Health Disclosures. You agree to disclose relevant health information, contraindications, pregnancy/post-partum status, surgeries, medical devices, or conditions that may affect treatments.

4) Services; Not Medical Advice

Our services are wellness/bodywork/esthetic services. We do not diagnose, treat, or cure medical conditions and do not provide medical advice. Results vary and are not guaranteed. Consult your physician before receiving services, especially if you are pregnant, post-operative, have cardiovascular or lymphatic issues, or other concerns.

5) Booking, Payments, Cancellations & No-Shows

Booking & Payments. Bookings may require a card on file and/or prepayment via Mindbody. You authorize us to charge your card for services, fees, and policy-based charges (e.g., late cancel/no-show), including applicable taxes. Gratuities are optional unless otherwise stated.

Rescheduling/Cancellation. Unless otherwise specified at booking or in a confirmation message, you must cancel or reschedule ≥ 24 hours before the start time to avoid a late cancellation fee (up to 50% of the service price); no-shows may be charged up to 100% of the service price. If different windows/fees are shown on your booking page or confirmation, those control.

Late Arrival. Arriving late may shorten your session; charges still apply.

Refunds. Completed services are non-refundable. If we cancel due to operational issues, we will rebook or credit you.

6) Memberships, Packages, Promotions & Gift Cards

Memberships/Packages. Any membership or multi-session offering has terms disclosed at purchase (billing cadence, renewal/cancellation, rollovers, expirations). We may pause, modify, or discontinue offerings with notice consistent with your agreement and applicable law.

Promotions. Promotional pricing cannot be combined unless stated. Promotions may have limited windows, eligibility criteria, and blackout dates.

Gift Cards. Gift cards are redeemable for eligible services/products at our studio. They are not redeemable for cash except as required by Texas law: if a gift card is redeemed in person and the remaining balance is less than $2.50, at your request we will provide cash for the remaining balance (subject to statutory exceptions). Federal CARD Act rules apply to expiration/fees as applicable.

7) Communications & Mobile Messaging (SB 140 + TCPA)

We may contact you via email, phone, or SMS/MMS for confirmations, reminders, service follow-ups, and—with your express written consent—limited promotional messages. Consent is not a condition of purchase.

  • Program: The Tox Dallas Alerts

  • Originating numbers: (214) 466-2496 and any successor long codes

  • Opt-out: Reply STOP to end; HELP for help

  • Rates: Message & data rates may apply; frequency varies

  • Quiet hours: For marketing messages, we observe Texas telemarketing quiet hours (generally 9:00 a.m.–9:00 p.m. Mon–Sat; 12:00 p.m.–9:00 p.m. Sun, Texas local time).

  • Compliance: We follow Texas SB 140 (marketing texts treated as telemarketing), Texas No-Call requirements, and TCPA rules requiring valid consent and honoring opt-outs.

  • Recordkeeping: We maintain consent/opt-out logs as required.

  • Service Providers: Messaging/CRM may be facilitated by HighLevel, RingCentral, and Twilio; scheduling by Mindbody; analytics via standard tools per our Privacy Policy.

  • CTIA/Carrier Rules: We align with CTIA best practices (e.g., clear opt-in, STOP/HELP).

Note: We do not send marketing messages outside the permitted hours. Transactional reminders may still be sent consistent with law and your preferences.

8) Accounts; Third-Party Platforms

You may need accounts with Mindbody or to submit forms via HighLevel. Third-party terms and privacy policies apply to those platforms. We are not responsible for third-party outages, data loss, or errors.

9) Reviews, Testimonials & User Content

If you submit reviews, testimonials, images, or comments, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute such content in connection with our services and marketing, subject to our Privacy Policy and applicable law. Do not submit content you do not own or that violates others' rights.

10) Intellectual Property

All studio content (including text, logos, graphics, photographs, video, and look-and-feel) is owned by us or licensed to us. The Tox brand is used under franchise license. You may not copy, reproduce, modify, or create derivative works without prior written consent.

11) Prohibited Conduct

You agree not to:

  • Interfere with or disrupt our systems or other users' experiences;

  • Use automated means to access booking systems beyond intended use;

  • Harass staff or clients or engage in illegal, unsafe, or discriminatory conduct;

  • Misuse our messaging programs (e.g., spoofing, fraud).

We may refuse or discontinue service for violations or safety concerns.

12) Privacy; Data Rights

Our Privacy Policy explains what personal data we collect, how we use it, and your rights under the Texas Data Privacy and Security Act (TDPSA) (access/correction/deletion/appeal; timelines). The Privacy Policy is incorporated by reference.

13) Disclaimers

AS IS. Except as explicitly stated, services and website content are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties (express, implied, or statutory), including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

No Guaranteed Results. Outcomes vary by individual; we do not guarantee results, weight loss, medical outcomes, or specific aesthetic effects.

Third-Party Links/Tools. We are not responsible for third-party sites, policies, or practices.

14) Limitation of Liability

To the maximum extent permitted by Texas law, we (including our owners, employees, contractors, and affiliates) are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, arising from or related to your use of our services or messages. Our aggregate liability for any claim is limited to the amount you paid us for the service giving rise to the claim in the 12 months preceding the event or $250, whichever is greater. Nothing here limits non-waivable consumer rights.

15) Indemnification

You agree to defend, indemnify, and hold harmless The Tox Dallas (and our owners, employees, contractors, and agents) from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, misuse of services, or violation of law or third-party rights.

16) Governing Law; Dispute Resolution

These Terms are governed by Texas law (without regard to conflicts rules) and the Federal Arbitration Act.

Binding Arbitration & Class Action Waiver. Except where prohibited by law, any dispute arising from or relating to these Terms or our services will be resolved by binding arbitration in Travis County, Texas under the AAA Consumer Arbitration Rules. No class or representative actions. Either party may bring an individual claim in small-claims court. Each party bears its own fees unless the arbitrator awards otherwise under applicable law.

17) Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control (e.g., severe weather, utility failures, strikes, pandemics/epidemics, government orders, platform outages).

18) Severability; Assignment; Entire Agreement

If any provision is found unenforceable, the remaining Terms remain in effect. You may not assign these Terms without our prior written consent; we may assign to an affiliate or successor. These Terms (plus our Privacy Policy and any service-specific terms disclosed at purchase) are the entire agreement between you and us.
